Juliet A. Davison focuses her practice in the areas of employment litigation and counseling, probate and fiduciary litigation and complex business litigation. She has achieved successful results through trial (in the state and federal courts), arbitration, mediation and negotiation.

In the area of employment law, Ms. Davison regularly represents clients in employer/employee disputes. She has prevailed in numerous non-competition and non-solicitation actions and in cases involving claims of disclosure of trade secrets and unfair competition. She has achieved favorable outcomes in matters involving claims of discrimination in employment, sexual harassment, wrongful termination, constructive termination, violations of the wage and hour laws and claims under the Americans with Disabilities Act and the Family Medical Leave Act.

In the area of probate and fiduciary litigation, Ms. Davison frequently represents individuals, beneficiaries, trustees and executors with regard to claims concerning estates and trusts, including the management and administration thereof, the duties and conduct of fiduciaries, the proper interpretation of trust and estate planning instruments and the effective exercise of powers of appointment. She has also prevailed for clients in proceedings involving the appointment and removal of fiduciaries, in will contests and in guardianship and conservatorship proceedings.

Ms. Davison has a wealth of experience in civil litigation. By way of example, Ms. Davison represented a municipality in multiple actions arising under the filed rate doctrine and raising issues of preemption under the Supremacy Clause of the United States Constitution. She has represented clients in matters raising complex issues of fraudulent conveyance, constructive trust and unjust enrichment under state law. And she is experienced in representing shareholders in disputes involving closely-held corporations and partners in partnership disputes. Ms. Davison has handled numerous cases involving claims of breach of contract, misrepresentation, breach of fiduciary duties and violations of Massachusetts General Laws chapter 93A.

Ms. Davison has also handled many appeals arising out of cases in which she prevailed in the lower courts.
