- May, 2024 On our Rule 12(b)(6) Motion, Davison Law obtains the dismissal of all claims against our client in the Business Litigation Session. The Court found that the plaintiff, Steward Medical Group, Inc., failed to state plausibly any claims against our client and ordered the dismissal of all claims against him.

- August, 2022 Davison Law prevails on its Rule 12(b)(6) Motion to Dismiss all claims with prejudice in the Business Litigation Session.—In this dispute among members of a closely-held Massachusetts corporation, plaintiff alleged that he was the sole owner of corporate shares issued jointly to him and his wife. The Court found that our client, plaintiff’s wife, had a present joint ownership and interest in the shares, and dismissed husband’s claim to sole ownership of the shares with prejudice. The Court further found that the Irrevocable Trust that husband and wife created to hold title to certain corporate shares was a valid Trust, rejecting husband’s claim that the Trust was never established.

- November, 2021 Davison Law wins summary judgment decision in the Massachusetts Land Court. In dispute concerning the existence and scope of an easement, Court found that our client has express easement rights for full access to his property.—The judge granted summary judgment to our client, concluding in her 49-page decision that the broad easement language in the controlling deeds was unambiguous. She also found that circumstances surrounding the original granting of the easement as part of a subdivision of family property and subsequent use of the driveway over the decades supports the broad grant of easement rights.

- October, 2016 DAVISON LAW Obtains Order Striking the Objections of the Surviving Spouse to the Allowance of Decedent’s Will and the Appointment of Decedent’s Son as Personal Representative of the Estate—In a case of first impression, the Probate Court struck the objections of the surviving spouse to the allowance of the decedent's Last Will and Testament and to the appointment of our client as Personal Representative of the Estate. It was alleged that the existence of a claimed pre-nuptial agreement barred the allowance of the will. The Court rejected that argument in its entirety.

- May, 2012 In Case of First Impression, Massachusetts Appeals Court Affirms Finding for Our Client That Guardian’s Funding of Trust Following Ward’s Death Was Unlawful—The Appeals Court upheld the judgment we obtained in the Essex Probate Court that a guardian’s funding of a (d)(4)(A) Trust after the ward had deceased was unlawful and ordering that the funds be repaid to the estate.
- May, 2012 DAVISON LAW Defeats Motion for Preliminary Injunction to Enforce Non-Competition Agreement—We defeated a motion for preliminary injunction in Middlesex Superior Court brought by DePuy Spine, Inc., a subsidiary of Johnson & Johnson. DePuy sought to prevent several sales representatives from joining a competing medical device distributor.
- May, 2012 Probate Court Orders Removal of Fiduciary and Appoints DAVISON LAW’s Client to Serve in her Stead—We received orders from the Barnstable Probate Court removing a fiduciary as executrix and trustee and appointing our client to serve in her stead, together with a substantial award of attorneys’ fees.
